Definitions of “law” vary widely, from utilitarian theories such as those promoted by John Austin, which assert that law is a set of commands, backed by the threat of sanction, from a sovereign to whom people have a habit of obedience; through to natural law theory (such as that advocated by St Thomas Aquinas) which posits that there are laws in nature, unchanging and universal.
This bill would amend the City’s data breach notification laws to align them with requirements in New York State law and to expand the obligations of private-sector entities whose systems experience a security breach to promptly disclose that fact to persons who have been impacted by that breach. This bill would also add new rules to implement Local Law 202 of 2019, and Local Law 144 of 2021, as well as Local Law 37 of 2022.
